(including its divisions and affiliates, such as Fresenius Kabi Canada Ltd., collectively “Calea”) collects and uses information about online visitors and particularly how we handle the personal information that you provide to us on websites controlled by Calea (collectively “Calea Website(s)” or “Website(s)”) which link to this Privacy Policy.

This Privacy Policy does not apply to personal information collected from you offline, to Calea websites that do not link to this Privacy Policy, to people from countries other than Canada, or to third-party web sites to which Calea web sites may link. Your use of Calea Websites which link to this Privacy Policy is subject to this Privacy Policy and the Terms of Use.

Please read this Privacy Policy before using Calea Websites or submitting personal information to us. By using Calea Websites or submitting personal information to us, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent to our collection, use and disclosure of your personal information in the manner described herein. You may withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice.

How does this Privacy Policy define “personal information”?

“Personal information” means information that identifies you or could reasonably be used to identify you and which is submitted to and/or collected by Calea Websites and maintained by Calea in an accessible form. Examples of personal information include your name, your postal address and your telephone number. Data that are not personal information shall be deemed to be non-confidential, and Calea shall be free to disclose and use the same, for any purpose and through any means, without any obligation whatsoever to you.

How does Calea collect information online?

Calea collects information in two ways:

  • Personal Information You Submit:
    Calea collects personal information that you enter into data fields on Calea Websites. For example, you may submit your name, postal address, e-mail address, and/or other information in order to receive information about various subjects, register for Calea programs, contact Calea customer service, or respond to Calea surveys. To protect your privacy, you should not provide Calea with any information that is not specifically requested or send any information that you consider sensitive or confidential, including your medical history, to us through use of a “Contact Us” e-form [or otherwise].
  • Passive Collection of Non-Personal Information:
    Calea Websites may collect information about your visits to Calea Websites on an anonymous basis without you actively submitting such information. Non-personal information may be collected using various technologies, such as cookies, Internet tags, and web beacons. Your Internet browser automatically transmits Calea sites some of this non-personal information, such as the URL of the website you just visited, the browser version your computer is operating and your IP address. Statistics may be compiled that related to usage of the Website including those that show the daily number of visitors to the Website, the daily requests received for particular files on the Website, and the routes by which users access the Website. Does Calea Website use cookies?

Like many websites, the Calea Websites use “cookies” to maintain a record of your visit to the Websites. Cookies are small pieces of text that are stored on your computer by your browser. They make our services more user-friendly, effective and secure. Cookies do not harm your computer and do not contain viruses or malware. For our own purposes, we use “session cookies” which will help to identify you while using our website. “Session cookies” will be deleted automatically after your visit.

The Calea Websites also use “tracking cookies” to improve how our Websites work. These cookies collect information analytics in aggregate form only; for instance about how often visitors use a page of our Website, which pages visitors go to most often, and if they get error messages from our pages. These cookies collect information on an aggregate basis and cannot be used to identify a single user of our Website. Whenever we use tracking cookies, your data will be immediately anonymized right after collection.

Purposes for which Calea may collect and use personal information

Calea will use the personal information you provide through Calea Websites to respond to your questions, to provide you with efficient customer service, for such other purposes about which we inform you when we ask you for information, and as otherwise required or permitted by law. We may also use your personal information for other business purposes, such as to offer you the opportunity to receive notices regarding Calea products or services, to invite you to participate in surveys about our products, or to notify you about special promotions.

Does Calea consolidate personal information?

Calea may consolidate the personal information of customers who use Calea Websites. We use this information to help us better design Calea Websites and Calea products, to communicate information to you, to enhance our marketing and research activities, and to facilitate other business functions.

What choices do I have about how Calea collects and uses personal information about me?

You can access and use much of this Website without telling us who you are or revealing any personal information. Some areas of the site, however, do allow you to contact us to ask questions or provide comments. You may always limit the amount and type of personal information that Calea receives about you by choosing not to enter any personal information into forms or data fields on Calea Websites; however, some of our online services can only be provided to you if you provide us with appropriate personal information. Who will have access to personal information about me?

Personal information can be accessed by a restricted number of Calea employees, by certain companies with which Calea may conduct joint programs, and by individuals and entities with whom Calea contracts to carry out business activities for Calea. We train our employees about the importance of privacy and how to handle and manage customer data appropriately and securely. Also, it is Calea’s practice to notify you if you are registering for a program which is conducted in conjunction with another company that may require access to your personal information. In addition Calea’s practice is to require its contractors to keep your personal information confidential and to use personal information only to perform functions for Calea.

Does Calea share personal information with third parties?

As a general rule, Calea does not share your personal information with third parties, unless it is useful to conduct a joint program or to carry out a program or activity through a contractor. Calea will not disclose your personal information to third parties for those third parties’ marketing purposes, unless you have been provided with an opportunity to opt out of this disclosure. However, in the event of an acquisition of assets or shares of Calea, including one or more of its product lines or divisions, whether by merger, acquisition, reorganization or otherwise, your personal information may be transferred to the buyer so that the buyer can continue to provide you with information and services.

If Calea provides your personal information to individuals and entities which assist us with our business activities, it is Calea’s practice to require those individuals and entities to keep your personal information confidential and to use your personal information only to perform functions for Calea. Calea reserves the right to disclose your personal information to respond to authorized information requests from government authorities, to address national security situations, or when otherwise required or permitted by law.

In some cases personal information may be disclosed, processed and stored in different jurisdictions outside of Canada, both to members of the Calea group and to third party service providers, as described above. Such personal information may therefore be available to government authorities under lawful orders and laws applicable in such jurisdictions. Does Calea share personal information with Regulatory or Law Enforcement Authorities?

If you contact Calea regarding your experience in using one of Calea’s products, Calea may use the information you provide in submitting reports to Health Canada, other regulatory authorities, and as otherwise required of us by law. Calea also may use the information to contact the prescribing physician to follow up regarding an unexpected event involving use of our product. By submitting such information, you agree that Calea may not be permitted to comply with your request to amend or remove personal identifiable information that was provided to Calea by a health care professional or a consumer regarding an adverse drug event. Additionally, Calea may be required by court orders or other laws to divulge information about you to law enforcement authorities or the courts. Calea will cooperate in responding to such requests, in accordance with the law, and will take appropriate measures to ensure that the requester understands the sensitive nature of the health-related personal information that they may receive.

How does Calea secure personal information?

It is Calea’s practice to secure each web page that collects personal information; however, the confidentiality of personal information transmitted over the Internet cannot be guaranteed. We urge you to exercise caution when transmitting personal information over the Internet, especially personal information related to your health. Calea cannot guarantee that unauthorized third parties will not gain access to your personal information; therefore, when submitting personal information Calea Websites, you must weigh both the benefits and the risks. In addition, Calea Websites covered by this Privacy Policy will display a warning whenever you link to a website that is not controlled by Calea; you should check the privacy policies of such third-party websites before submitting personal information.

Does Calea’s Privacy Policy apply to third party sites?

The Calea Website may contain links to other sites, and we make every effort to link only to sites that share our high standards and respect for privacy. However, our Privacy Policy does not apply to those other sites and we are not responsible for the content or the privacy practices employed by such other sites.

How does Calea protect the privacy of children?

Calea does not knowingly collect or use any personal information from children (we define “children” as individuals younger than 18) on Calea Websites. We do not knowingly allow children to order our products, communicate with us, or use any of our online services. If you are a parent and become aware that your child has provided us with information, please contact us using one of the methods specified below, and we will work with you to address this issue.

How may I correct personal information or delete it from current customer records?

You may request to remove your personal information from our current customer records or to amend your personal information. Please notify us of your wishes by contacting us in one of the ways specified below. Please note the limitations on revising information relating to experience with Calea products explained above. For our record keeping purposes, we will retain certain personal information you submit in conjunction with commercial transactions.

We will do our best to respond to all reasonable requests in a timely manner.

How will I know whether Calea has updated this policy?

Calea reserves the right to amend this Privacy Policy without prior notice to reflect technological advancements, legal and regulatory changes and good business practices. If Calea changes its privacy practices, a new Privacy Policy will reflect those changes and the effective date of the revised Privacy Policy will be set forth in this paragraph.
